SHC seeks arguments on a plea against sealing restaurant

KARACHI:Sindh High Court (SHC) on Thursday sought arguments from deputy attorney general till 30th January on a plea against the sealing of a private restaurant after the death of two children in Clifton.

A two-member bench of the SHC, headed by Justice Muhammad Ali Mahzar, heard the plea and sought a reply from deputy attorney general.

The counsel of the petitioner told the court that the restaurant and warehouse are under the authority of the cantonment.

Sabteen Mahmood, additional advocate general, replied that provincial departments could not be stopped from taking action in the remits of cantonment because provincial laws apply in all parts of the province.

He said cantonment food act is the controversy with the articles of the constitution. The bench asked was a case against the owner of the restaurant over?

The restaurant owner’s counsel told the court that victim family and the restaurant owner had compromised. Additional Advocate General said will be a compromise regarding criminal proceedings, so this case is not related to the seal of warehouse.

Lawyer of the Sindh Food Authority said Sindh Food Authority could take action anywhere in the province. ‘’Two children died, women was also affected but the cantonment did not take any action,’’ the lawyer said

The applicant said that the federal laws were being applied in this area so the Sindh Food Authority could take action in this area.

The court, later, adjourned hearing till 30th January.
