CCP Imposes Rs375 Million in Fines on Fertilizer Firms for Collusion

The Competition Commission of Pakistan has imposed fines totaling Rs375 million on six major urea manufacturers and an industry association for anti-competitive behavior that artificially fixed fertilizer prices in the country.

The Commission penalized each manufacturer Rs50 million and the Fertilizer Manufacturers of Pakistan Advisory Council (FMPAC) Rs75 million after a suo motu inquiry revealed coordinated price-fixing activities under the guise of an awareness campaign.

The Commission’s investigation, led by Dr. Kabir Ahmed Sidhu and Mr. Salam Amin, determined that companies including Fatima Fertilizer Limited, Fauji Fertilizer Company Limited, and Engro Fertilizer Company Limited collaborated with FMPAC to set uniform urea prices, breaching Section 4 of the Competition Act, 2010. Despite assertions of pricing independence, the firms could not provide evidence to justify their synchronized pricing.

The inquiry further uncovered that the collusive actions distorted market competition, harming farmers during crucial farming seasons by limiting market choice and inflating prices. The Bench dismissed the respondents” defense citing the “state action doctrine,” noting no governmental directive mandated such collusion. The Commission underscored that the actions undermined competitive pricing mechanisms by misusing a Federal Government directive meant for public awareness.

Concerns were raised over identical pricing by manufacturers despite varying input costs and market conditions, with each company charging Rs1768 per urea bag. The Benchmark criticized the repeated failure of these manufacturers to address supply imbalances despite warnings issued in previous years.
