HC IOK directs jail officials to provide medical relief to Fakhtoo

Srinagar, April 12, 2019 (PPI-OT): In occupied Kashmir, the High Court has directed the authorities of Udhampur Jail to provide all medical facilities to illegally detained Hurriyat leader and the President of Muslim Deeni Mahaz, Dr Muhammad Qasim Fakhtoo. The directive was passed to the jail Superintendent to take necessary steps in this regard and ensure proper medical facilities to the detained leader.

On Wednesday, the court had directed the Additional Advocate General (AAG), BA Dar, to seek instructions into the matter by the next day. He submitted before the court that he had communicated with the jail Superintendent, who told him that Dr Fakhtoo had been provided medical care and a physician had also examined him.

The petitioner’s counsel, Mian Abdul Qayoom, stated in the court that no proper medical care was yet provided to Dr Fakhtoo, who was suffering from different ailments. The division bench of Chief Justice, Gita Mittal and Justice Tashi Rabstan, after hearing both sides, directed the Superintendent of Udhampur Jail to provide all medical facilities to the applicant related to his medical condition forthwith. The bench also observed that under law, authorities are bound to provide medical care to any detained person.

Dr Muhammad Qasim Fakhtoo, who is the husband of illegally detained Chairperson of Dukhtaran-e-Millat, Aasiya Andrabi, has been in prison since his arrest in February 1993. He was arrested in a false murder case registered against him in 1992. A Jammu court had acquitted him in 2001 but the Indian Supreme Court overturned the verdict and sentenced him to life imprisonment in 2003. He has completed more than 26 years of imprisonment.
