Indian SC hands over Babri Masjid land to Hindus

New Delhi, November 09, 2019 (PPI-OT): Showing its communal Hindu face once again, the Supreme Court of India has awarded the land of Babri Masjid in Ayodhya to Hindus for the construction of a temple. A bench headed by Chief Justice Ranjan Gogoi in its verdict in Ram Mandir-Babri Masjid case, said the site of Babri Masjid will be given to a government-run trust for the building of a temple. However, the bench also comprising Justices SA Bobde, DY Chandrachud, Ashok Bhushan and S Abdul Nazeer ruled that Muslims must get alternate land within the city for the construction of a mosque.

The Supreme Court has given the entire disputed 2.77-acre land to the Hindu parties with a trust to be formed by the Indian government to monitor the construction of a Ram Temple. This is the same land on which historic Babri Masjid was situated. However, Hindu extremists had demolished the mosque in December 1992.

The Indian Supreme Court in its verdict said archaeological excavations suggest that there was an underlying structure under the Babri Masjid which was “not of Islamic origin”. The court said there is sufficient evidence to suggest that the Babri Masjid was not constructed on “vacant land”. It said the Archaeological Survey of India (ASI) also could not suggest that there was a temple of the 12th century at the disputed site. It said the ASI has not specifically said that the underlying structure was a temple.

Chief Justice of India Ranjan Gogoi said the ASI report has left unanswered a critical part of its remit i.e. whether a Hindu temple was demolished to construct the Babri Masjid. The Supreme Court said there is no archaeological evidence of what existed between the 12th century and the 16the century when the Babri Masjid was built.
