Peshawar High Court directs Inspector General prisons to transfer the Swara case to Peshawar

Peshawar: The Peshawar High Court PHC on Monday issued orders to concerned authorities to transfer the Swara and double murder case of district Upper Dir to Peshawar.

A single member bench headed by Chief Justice Dost Muhammad Khan issued these directions while hearing petition, filed by Hafeez-ur-Rahman brother of a minor girl Asma.

The petitioner earlier stated that his sister Asma was likely to be kidnapped by the accused as they threatened them to give the girl in Swara despite they had killed the brother and father of the girl.

The bench directed Inspector General IG Prison to transfer all the five under trail accused Ezat Muhammad, Nasrullah, Wazir Muhammad, Naqeed Ahmad and others arrested in the charges of double murder and swara cases to Peshawar.

The petitioner stated that his family was in danger and facing life threats from the remaining accused in his locality, therefore he prayed the court to transfer both the cases into Peshawar.

The local police also brought the accused before the court where they denied the allegations of giving life threats to Asma’s family. However the court was not satisfied with the statements.

It is o be worth mentioned the petitioner had submitted an application with PHC alleging his sisters, Ms Rafia, was married to SubhanAllah but later due to domestic clashes her sister secured khula divorce through a family court.

Later, her sister was married to another person in Punjab. And now the family members of her ex-husband, including his uncles and brothers, who demanded that his small sister, Asma, who was at that time only two years old, be given to them in swara.

The petitioner told the court upon ref refusal the accused killed his father, Maulana Daud and Brother Abdul Hameed on November 12, 2011 and afterwards start threatening him and his family.
