Supreme Court takes initiative of devising strategy for resolution of water scarcity

Islamabad, October 15, 2018 (PPI-OT): The Honourable Supreme Court of Pakistan has taken the initiative of devising a strategy for the resolution of water scarcity as well as the timely formulation of effective policies for water preservation in Pakistan. In this context the Law and Justice Commission of Pakistan (LJCP) under the aegis of the Honourable Supreme Court of Pakistan is organizing two-day International Symposium on 19th-20th October 2018 on the theme “Creating a Water-Secure Pakistan”. Jurists, luminaries of Law and experts in water resource management, academia and researchers from different countries will present their Research papers.

There will be five thematic sessions under the following titles:

1. Legal Aspects of Indus Basin Water

2. Construction of Dams and Reservoirs

3. Financing of Dams and Reservoirs

4. Ground Water, Water Recharge and Water Pricing

5. Water Resources Governance and Management

The first theme focuses on the Indus Basin Water which is the main source of irrigation in the country and main contributor in the country’s economy. In this theme discussions will be made on the Indus Basin Water Treaty 1960. Legal and water experts will discuss the importance of the Indus Water Treaty, its origin, evolution and future prospects. Moreover, international experts from United States of America and Australia will discuss similar issues in comparable basins in these countries.

The second theme will cover the issue of construction of dams and water reservoirs which are need of the day for effective storage of water and generation of hydroelectric power. In this session the experts will discuss the need of construction of new dams of Pakistan as per requirement of ever-growing population of Pakistan. Moreover, deliberations would also be made on the challenges of dam designs and building of small dams. International experts will discuss the short term and long-term actions required for construction of dams and sediment management in the indus.

The third session will focus on the financial aspects of the construction of dams. Experts will give suggestions for the purpose of the raising funds for construction of dams including installation of more hydroelectric power plants and consequently generating funds from such hydro power generation.

The fourth session will discuss the reasons for the shortage of the ground water, devising strategies to recharge the aquifer and water pricing regimes that could be introduced on the extraction of the underground water.

The fifth session will cover the issue of challenges involved in confronting water governance and improvement in current water data collecting strategies. Deliberations would also be made on introducing water reforms for governance of consumption of water and empowering concerned institutions like WAPDA.

The inaugural session will be chaired by His Excellency, Dr. Arif Alvi, President, Islamic Republic of Pakistan. The concluding session will be chaired by the Honourable Chief Justice of Pakistan.

Supreme Judicial Council dismisses all complaints against Justice Muhammad Anwar Khan Kasi, Chief Justice Islamabad High Court

Islamabad, October 12, 2018 (PPI-OT): Supreme Judicial Council under the Chairmanship of Hon’ble Chief Justice of Pakistan Mr. Justice Mian Saqib Nisar met on 11.10.2018 (Thursday) at Supreme Court of Pakistan, Islamabad. The Council examined the four complaints pending with SJC against Hon’ble Mr. Justice Muhammad Anwar Khan Kasi. After detailed deliberations and discussion the Council came to the conclusion that on the basis of material available on record no case of misconduct was made out against the Hon’ble Judge. Therefore, the Supreme Judicial Council dismissed all the complaints against him.

Chief Justice of Pakistan takes notice of alleged illegal encroachment over properties belonging to Hindu Community in Sindh

Islamabad, October 12, 2018 (PPI-OT): The Hon’ble Chief Justice of Pakistan Mr. Justice Mian Saqib Nisar has taken notice of alleged illegal encroachment over the properties belonging to Hindu Community in Sindh. The notice was taken on a video of Prof. Dr. Bhagwan Devi w/o Prof. Dr. Baghwan Das viral on social media, alleging that her lands and properties are being encroached by land mafia by force. Bogus Power of attorneys are being prepared in the upper Sindh, due to which the Hindus feel insecure. Many Hindus are leaving and migrating to other countries and many others are preparing to sell their properties and leave. She further alleged that the Federal and Provincial Governments are reluctant to take action in this regard.

Taking notice of the issue, the Hon’ble Chief Justice of Pakistan has fixed the matter in the Court on 18.10.2018 with notice to Attorney General for Pakistan, Advocate General, Sindh, Secretary, Religious Affairs and Interfaith Harmoney, Islamabad, Secretary, Human Rights, Islamabad, Chief Secretary, Sindh, Secretary, Minority Affairs Department, Government of Sindh and Commissioner, Larakan Division to appear before Court.

Turkish delegation calls on Chief Justice of Pakistan

Islamabad, October 12, 2018 (PPI-OT): A Turkish delegation headed by Mr. Yavuz Selim Kiran, Deputy Minister of Foreign Minister, accompanied by Mr Ihsan Mustafa Yurdakul, Turkish Ambassador to Pakistan and comprising other officers of Turkish Government paid a courtesy call on the Hon’ble Chief Justice of Pakistan Mr. Justice Mian Saqib Nisar at Supreme Court of Pakistan, Islamabad today i.e. 12.10.2018. The delegation was on visit to Pakistan.

Hon’ble Chief Justice of Pakistan welcomed the delegation and said that both the countries have cordial relations and possess common social values, norms and religion therefore both can benefit by sharing experience and knowledge. His lordship also gave them an insight into the judicial system of Pakistan.

The delegation thanked the Hon’ble Chief Justice of Pakistan for sparing his time. Mr. Yavuz Selim Kiran, Deputy Minister of Foreign Minister presented souvenir to the Hon’ble Chief Justice of Pakistan as token of respect and gesture of goodwill. His lordship also reciprocated the gesture by presenting a memento on the occasion.

Chief Justice of Pakistan takes notice of alleged illegal encroachment over property belonging to Kalash Tribe

Islamabad, October 11, 2018 (PPI-OT): The Hon’ble Chief Justice of Pakistan Mr. Justice Mian Saqib Nisar has taken notice of alleged illegal encroachment over the property belonging to Kalash Tribe. The notice was taken on an application of the Kalash tribesmen that they are living in their area from medieval times and having population of about 300 persons. They are in occupation of a common pasture and some lands. One Maqsood ul Mulk wants to snatch this land from them. They have already filed a petition before Peshawar High Court in this regard but still the threats persist.

Taking notice of the issue, the Hon’ble Chief Justice of Pakistan has fixed the matter in the Court on 17.10.2018 with notice to Advocate General Islamabad, Chief Secretary KPK, IGP, KPK and Deputy Commissioner Chitral to appear before Court.

Delegation of Course Participants of 109th NMC, National Management College, calls on Chief Justice of Pakistan

Islamabad, October 10, 2018 (PPI-OT): Today a 59 member delegation comprising faculty members and course participants of 109th National Management Course, National Management College, Lahore called on Hon’ble Chief Justice of Pakistan Mr. Justice Mian Saqib Nisar in Supreme Court Islamabad today i.e. 10.10.2018 as a part of their inland study tour.

Hon’ble Chief Justice of Pakistan Mr. Justice Mian Saqib Nisar welcomed the delegation and gave them an overview of the Constitution of 1973 of Islamic Republic of Pakistan. His lordship explained to them trichotomy of power and dilated upon the role, function and importance of each limb of the State i.e. Legislative, Executive and Judiciary. His lordships briefed them on principles of natural justice, judicial system of Pakistan, its functioning, role, dispensation of justice and constitutional jurisdiction of Supreme Court of Pakistan to provide relief to people.

His lordships underlined the need that the bureaucracy, being an implementing organ of the State, must gain adequate knowledge of administrative laws to dispense their duties independently, honesty and transparently in accordance with the law and the Constitution. They must strive to gain full knowledge of the guidelines set by superior courts on administrative issues and principles of natural justice to serve the purpose of justice. He said that vibrant bureaucracy is sine qua non for the State, therefore, bureaucracy must try its level best to ensure good governance in the country.

He also explained that Supreme Court under constitutional scheme possesses special jurisdiction of the judicial review to examine certain acts of legislative and executive organs of the State repugnant to the Constitution. Furthermore, Hon’ble Chief Justice told them about the fundamental rights enunciated in the Constitution and emphasized the need of enforcement of fundamental rights. He expected the same from them being the part of the senior bureaucracy of the country to respect and enforce fundamental rights of the people. Later, he answered the questions of the participants in an interactive session and shared his experiences.

Mr. Azmat Ali Ranjha, Rector, National School of Public Policy thanked the Hon’ble Chief Justice of Pakistan on his own behalf and on behalf of the participants. The delegation presented souvenir to Hon’ble Chief Justice of Pakistan and extended thanks for sparing time for them. The Hon’ble Chief Justice of Pakistan also reciprocated the gesture by presenting a memento on the occasion.
