Shopkeepers of Mehran Complex Sukkur have filed a review petition in the Sindh High Court today, challenging the alleged illegal demolition of their shops. This petition was presented in the Sukkur bench by Advocate Zaheer Babar on behalf of Muhammad Sharif Bandhani and other affected traders.
The legal representative of the shopkeepers, Advocate Babar, claimed that the demolition of 42 retail units by the Sukkur Municipal Corporation and the Deputy Commissioner was carried out without proper legal basis, even though the relevant revenue documents were present. According to Babar, this action has caused significant economic loss to the involved traders.
The petition refers to a recent federal constitutional court decision, which overturned the Supreme Court’s previous decision in the Nasla Tower case. Citing this precedent, the petitioners have sought judicial intervention to rectify the perceived injustice faced by the shopkeepers of Mehran Complex.
The petition names Sukkur Municipal Corporation, the Mayor of Sukkur, the Deputy Commissioner, and other relevant authorities as respondents. The petitioners demand that the court review the previous actions, closely examine the conduct of the authorities in question, and provide appropriate legal compensation.
Furthermore, the petition also requests the court to summon all relevant records to facilitate a legal resolution of the issue. The outcome of this case could establish an important precedent for future disputes between municipal authorities and business owners.
