The Supreme Court (SC) on Thursday reserved its decision on an appeal by Zafarullah Kakar, imprisoned since 2017 for narcotics trafficking. Kakar received a life sentence for smuggling.
During proceedings, banter arose among the justices regarding the convict’s tribal affiliation. Justice Hashim Kakar inquired about the location of a shrine, with Justice Ishtiaq Ibrahim clarifying Kakar’s origins in Balochistan. Justice Hashim Kakar emphasized his lack of personal connection to the convict.
Prosecutors informed the court that 12 kilograms of cannabis were seized from the accused. Upon learning the drugs were carried on foot, Justice Hashim Kakar expressed amusement, suggesting the penalty was for the method of transport, not the crime itself.
Defense attorney Qamar Sabzwari argued procedural irregularities, claiming the officer who confiscated the narcotics also investigated the case, including transporting the evidence. Sabzwari contended this violated established legal protocol.
Justice Ishtiaq Ibrahim acknowledged the presence of other officers but noted the investigation appeared to be dominated by a single individual. The court then reserved its judgment, postponing further proceedings.
