Petition Seeks Supreme Court Full Bench for 26th Amendment

The Tehreek-e-Tahafuz-e-Aeen Pakistan has taken a significant step by filing a petition in the Supreme Court, demanding the formation of a full bench to deliberate on the 26th Constitutional Amendment. This development comes as the party challenges administrative decisions that have hindered the implementation of the majority verdict issued on October 31.

Mustafa Nawaz Khokhar, a prominent leader of the party, submitted the plea, emphasizing the necessity for the apex court to adhere to the Practice and Procedure framework. The petition argues that the administrative choice to ignore the committee’s ruling should be invalidated. It also highlights that the committee’s decision to establish a full court for the 26th Amendment was binding.

Furthermore, the document asserts that amendments introduced in the Practice and Procedure Act are at odds with constitutional principles and legal standards. It contends that neither the registrar nor any other official has the authority to countermand the committee’s verdict. The plea criticizes the Chief Justice’s explanation for the non-implementation, asserting that it lacks legal validity.
