Srinagar, August 09, 2018 (PPI-OT): In occupied Kashmir, the High Court Bar Association (HCBA) has expressed deep concern over the shifting of illegally detained Chairperson of Dukhtaran-e-Millat, Aasiya Andrabi along with her associates Nahida Nasreen and Fahmida Sofi to Tihar Jail in New Delhi.
The HCBA spokesman in a statement issued in Srinagar demanded of the International Committee of Red Cross and other human rights organizations to send their teams to Tihar Jail, New Delhi, to see for themselves the condition of Aasiya, Nahida and Fahmida, who are lodged in the jail.
“Their family members who visited the jail were denied any meeting and were asked to come after four days,” the HCBA said. The statement termed it as a clear violation of the directions of even India’s own Supreme Court, which allow the family members of the under-trial prisoners lodged in jail to meet them at least twice a week.
The Bar Association maintained that “an under trail prisoner/detenue while in jail is not denuded of his/her legal or fundamental rights and all those aspects of life which make a person to live with human dignity are included in the meaning of right to life, to which an under trial prisoner or a detenue is entitled to under the International as well as the domestic laws.”
The jail authorities, the HCBA added, should have allowed the family members of the aforesaid ladies from Kashmir to meet them in Tihar Jail. “The refusal to do so is not only unethical but immoral, undemocratic, unjustified, unwarranted and illegal,” the Bar Association said.
